Terms and Conditions - Replacing your provider's Set Top Box on Smart TV's - no extra hardware required!

This is Smart-STB's Terms and Conditions agreement!

This document exists to protect both you and us. By using our services, you agree to our Terms and Conditions agreement.

Smart-STB (collectively "website" "we", "us" or "our" etc.) is a Trademark of Olena Trading CC (collectively "company")

A Service Provider can be any provider of IPTV portal middleware (Paid, free and/or open source, with or without add-ons). Our terms and conditions of service provided to you, cover the use of our application only, and you are advised to adhere to the terms of conditions of such middleware and other providers.

The Terms and Conditions apply to all users of the Services even ff you are using any of the Services on behalf of an 3rd party organization, or company.

Agreeing to use the Services by clicking "Order Now" constitutes your acceptance and agreement to be bound by these Terms and Conditions

By using our Website or purchasing our application, you agree that we may collect and use your personal information in accordance to the applicable law. We take privacy of our customers seriously.

The Company will strive to provide a consistent level of service availability and performance, but will not be liable for failure or delay in performance obligations due to circumstances beyond its control. This includes but is not limited to acts of war, sabotage, fire, flood, strike, unavailability or delay of third party services, or power used by the equipment needed.

The Company will not be held liable for any errors, damage, malfunction, or other unexpected events happening on your TV resulting from the use of the Service. Use the Service on your TV at your own risk!

We reserves the right, at any time and from time to time, to amend or to modify these Terms of Service without prior notice to you.

By registering with your information, you are guaranteeing the services offered are solely for your use and not a third party – and that all of the information is accurate. Applicable to all End-User licenses!

We can't be held responsible for the content provided by your Service Provider or content you access elsewhere while using the Service.

Also ammount and type of content (TV channels, Video on Demand, Online radio, Audiobooks and all other possible content delivery of the middleware), the quality and legality of provision are not within our control and you as a consumer are solely responsible for such content usage where there is applicable law regarding such usage.

Due to the way the Service is designed to work with the TV's - access to Services located inside any kind of Intranet or firewalled Internet resource (example: Portals in Local Area Networks) is not possible directly. You must contacts us to arrange a solution depending on the network conditions.

If you are breaking laws, being obscene, or abusing our infrastructure or any provider's infrastructure, we have the right to suspend your access to the Service. You must also notify us before registering multiple accounts or reselling service with the same billing address to prevent being flagged for abuse. You're also responsible for the acts of others utilizing access to our services via your licenses, as we have no way of distinguishing your actions from the actions of your sub-users. Be careful who you give your licenses to – it's to protect both us and you!

We currently accept payment through PayPal. In case of fraudent payment, dispute or chargeback we reserve the right to block your access to the Service You may, however, reach out to us to discuss potential issues with the payment in case such occur. We can provide refund only in case of valid justification. You're typically billed monthly for the next month's usage. In case of Lifetime licenses you are billed once.

Licenses are non-refundable. We may transfer a license to your new TV but reserve the right of not doing so in case of license mis-use. For example: you have changed 3 TV's in the last month.

If you have received a Promo code, you must redeem it within 2 months of the date it was issued. All other credit will remain on your account as long as you're active in a given 2 month period.

If you violate these Terms of Service, then we have the right to suspend your account. You, however, are free to terminate your account without reason at any time.

In case of litigation the affected party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute. In the interest of resolving disputes between you and us in the most expedient and cost effective manner, you and the company agree that every dispute arising in connection with these Terms will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts.
